3 Steps After Receiving a Letter of Demand

When it comes to a legal issue be it a boardroom tussle, contractual dispute or a personal injury claim, a letter of demand (“LOD”) is usually the first document that surfaces and signifies the beginning of a legal action.

A LOD serves as a document that puts forward the issuer’s complaints or assertions of his/her legal rights which demands the recipient to do an act (for eg: payment of the contractual sum, making an apology statement, performance of an agreement).

Here are the steps that you should take after receiving a LOD:

  1. Do not ignore the LOD. An issuer would normally set out his/her complaints in the LOD. Non-response to the LOD may amount to an admission.
  2. Prepare and keep documents (letters, emails, WhatsApp conversation)that are relevant to the subject matter.
